Terms and Conditions for Pedal

Welcome to Pedal! These Terms and Conditions ("Terms") govern your use of the Pedal application and its associated services (collectively, the "Service"), provided by "Thijs van Hal" ("Pedal", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Description of Service

Pedal provides Search Engine Optimization (SEO) tools accessible through our application. The Service operates on a pay-as-you-go model. Users add funds to their account balance ("Balance") and are charged based on their usage of specific tools within the Service. There are no recurring subscriptions.

2. User Accounts

a. Registration: To use the Service, you must register for an account ("Account"). You agree to provide accurate, current, and complete information during the registration process, specifically your name and email address.

b. Account Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

c. Eligibility: You must be at least 18 years old to use the Service, or the age of legal majority in your jurisdiction if different.

3. Payments and Balance

a. Adding Balance: You can add funds to your Account Balance through the payment methods offered via our third-party payment processor, Paddle. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

b. Pay-As-You-Go Usage: Fees for using specific tools within the Service will be deducted from your available Balance at the time of use. The cost for each tool usage will be clearly indicated within the application.

c. No Subscriptions: Pedal operates solely on a pay-as-you-go basis. There are no recurring subscription fees.

d. Paddle: All payments are processed by Paddle. Your use of the payment services is subject to Paddle's own terms and conditions and privacy policy. Pedal does not store your full payment card details.

4. Use of the Service

a. License: Subject to these Terms, Pedal grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes.

b. Acceptable Use: You agree not to misuse the Service. This includes, but is not limited to:

  1. Engaging in any activity that interferes with or disrupts the Service.

  2. Attempting to gain unauthorized access to the Service or its related systems or networks.

  3. Using the Service for any illegal or unauthorized purpose.

  4. Reproducing, duplicating, copying, selling, reselling, or exploiting any portion of the Service without express written permission from us.

  5. Using automated systems or software to extract data from the Service (scraping) beyond the intended functionality.

5. User Data and Content

a. Tool Outputs: Data generated by your use of the SEO tools ("Tool Outputs") will be stored securely for a period of seven (7) days, after which it may be automatically deleted, unless otherwise specified for a particular tool.

b. Rank Tracker Data: Data specifically related to the Rank Tracker tool will be stored securely until you choose to remove it from within the Service.

c. Ownership: You retain ownership of the data you input into the Service and the Tool Outputs generated specifically for you.

d. No User-Generated Content: The Service does not currently permit users to upload or share content publicly (e.g., comments, posts).

6. Intellectual Property

The Service and its original content (excluding data provided by users), features, and functionality are and will remain the exclusive property of Pedal and its licensors. The Service is protected by copyright, trademark, and other laws of both the Netherlands and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of Pedal.

7. Termination

a. By You: You may stop using the Service and request deletion of your account at any time by contacting us at mail@thijsvanhal.nl.

b. By Us: We may terminate or suspend your access to our Service immediately. We will notice this to you, unless the breach is severe (involves illegal activities, security risk, significant disruption to the service). Upon termination, your right to use the Service will immediately cease. Account termination may result in the deletion of your data associated with the account.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PEDAL DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS; THAT THE SERVICE WILL BE AVAILABLE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PEDAL, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE. UNDER NO CIRCUMSTANCES WILL PEDAL BE RESPONSIBLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED EUROS (€100) OR THE AMOUNTS PAID BY YOU TO PEDAL FOR THE PAST THREE MONTHS OF THE SERVICE IN QUESTION.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
